Terms and Conditions

(Sustainable, Responsible & Inclusive Travel Platform)

1. About Hotel Resilient

Hotel Resilient Certifications UG (haftungsbeschränkt), registered in the Federal Republic of Germany under HRB 736873 (“Hotel Resilient”, “we”, “us”), operates a digital platform that supports accommodation providers and tourism stakeholders in understanding, improving, and communicating their sustainability, social responsibility, and inclusive practices.

Hotel Resilient operates as a public-benefit and mission-led organisation. Access to the Platform is provided free of charge to hotels and travel partners and is supported through grants, donor funding, partnerships, and in-kind contributions.

2. Definitions

  • Platform: The Hotel Resilient web-based application, which includes digital tools and related services.
  • User: Any organisation or individual accessing the Platform.
  • Participant: A User who submits data or documentation through the Platform.
  • Accommodation Provider: An entity operating a hotel, resort, lodge, or similar accommodation.
  • Assessment: A structured self-reported evaluation of the hotel’s (or similar) business practices, which may include sustainability, social responsibility, and inclusive practices.
  • Hotel Resilient Intellectual Property (IP): All software, tools, methodologies, content, trademarks, and materials developed or owned by Hotel Resilient.
  • Results: Refers to the answers provided by hotels in their self-assessment, as well as the assessment score.

3. Scope of Services

Hotel Resilient provides services intended to support learning, transparency, and continuous improvement in sustainable, responsible, and inclusive tourism, including:

  • Digital self-assessment tools
  • Data aggregation, scoring, and benchmarking
  • Guidance materials and good-practice resources
  • Dashboards and reports for internal and voluntary external communication

All services are informational and analytical in nature. Hotel Resilient does not issue certifications, guarantees, endorsements, or approvals, and does not verify legal or regulatory compliance.

4. User Accounts and Participation

  • Access to the Platform is free of charge for hotels and travel partners.
  • Use of the platform requires account registration.
  • Users confirm they are authorised to submit information on behalf of their organisation.
  • Users are responsible for the accuracy of submitted information.
  • Participation does not create any partnership, agency, or fiduciary relationship between the User and Hotel Resilient.

5. Assessments and Results

  • Assessments are primarily based on self-reported information, unless explicitly stated otherwise.
  • Scores, reports, and visualisations reflect information available at the time of submission.
  • Results are intended to support internal decision-making, learning, and voluntary transparency.
  • Results are meant to inform travel partners of the specific measures hotels are taking in terms of sustainable, responsible and inclusive practices.
  • Results must not be represented as certification or accreditation.
  • Results should only be promoted where they have been backed up with supporting documentation and/or verified by qualified travel partners / reviewers.

Hotel Resilient reserves the right to amend, suspend, or remove results where misuse, misrepresentation, or material inaccuracies are identified.

6. Fees and Funding

  • No fees are charged for access to or use of the Platform by hotels or travel partners.
  • Hotel Resilient may receive funding through grants, donors, partnerships, or public funding programmes to support platform development, maintenance, and research activities.
  • Participation in research pilots, funded projects, or optional value-added services (if introduced in the future) will always be voluntary and clearly disclosed.

7. Data, Privacy, and Use of Results

  • Users retain ownership of all submitted data.
  • Hotel Resilient may use aggregated and anonymised data for research, benchmarking, reporting, and advocacy related to sustainable, responsible, and inclusive tourism.
  • Publication of identifiable results occurs only with explicit User consent.
  • Data processing complies with applicable data protection laws and the Hotel Resilient Privacy Policy.

8. Intellectual Property

  • All Hotel Resilient intellectual property remains the exclusive property of Hotel Resilient.
  • Users are granted a limited, non-exclusive, non-transferable licence to use their assessment outputs for internal use and voluntary external communication.
  • Platform tools, methodologies, and content may not be copied, modified, or reverse-engineered.

9. Disclaimers and Limitation of Liability

  • The Platform and services are provided “as is” and “as available.”
  • Hotel Resilient makes no warranties regarding accuracy, completeness, or fitness for a particular purpose.
  • Hotel Resilient shall not be liable for indirect, incidental, or consequential damages arising from:
    • Use of the Platform
    • Reliance on assessments or reports
    • Public communication of results

Liability is limited to cases of gross negligence or wilful misconduct, to the extent permitted by law.

10. Acceptable Use

Users agree not to:

  • Misrepresent assessment results as certification or accreditation
  • Use outputs in a misleading or deceptive manner
  • Submit false, incomplete, or outdated information
  • Apply one assessment to multiple properties without authorisation
  • Copy or exploit Platform tools for competing purposes

Hotel Resilient may suspend or terminate access for misuse or breach of these Terms.

11. Amendments and Termination

  • These Terms may be updated periodically.
  • Continued use of the Platform constitutes acceptance of updated Terms.
  • Users may discontinue participation at any time.

12. Governing Law and Jurisdiction

These Terms are governed by the laws of the Federal Republic of Germany.
Jurisdiction lies with the competent courts in Germany.
